Terms of Service
Effective July 8, 2026 · ReSpec Digital, a Side Quest Adventure LLC company (Richmond, KY)
These terms cover working with ReSpec Digital (respecdigital.com) - designing, building, and maintaining your website. We keep them short and plain because that's how we'd want to read them. By engaging us for a project or a care plan, you agree to these terms. The specific scope, price, and timeline for your project live in the written proposal or agreement we send you; if anything there conflicts with this page, your signed proposal wins.
What we do
ReSpec Digital builds modern, fast, mobile-friendly websites for local businesses, and offers optional monthly care plans (hosting, SEO upkeep, Google Business Profile help, monthly reporting, and a set number of content edits). We're a website service - we don't provide legal, accounting, or marketing-results advice, and we don't host your email (we'll help you set up Google Workspace or Zoho and preserve your records during a move).
Quotes, proposals & spec demos
- Any demo or mockup we build before you hire us is provided free and with no obligation - it's a sample, not a finished deliverable, and it remains our work until a project is agreed and paid.
- Pricing in a proposal is valid for 30 days unless we say otherwise.
- Work begins after you accept the proposal and pay the deposit (below).
Deposits & billing
- A non-refundable deposit is required before we start design and build work. It reserves your project slot and covers setup and hard costs (tooling, assets, launch). Because that work begins right away, the deposit is non-refundable - we'll always tell you the amount up front, in writing.
- Remaining build fees are billed as agreed in your proposal (typically on launch, or across milestones for larger builds).
- Care plans are subscriptions, billed monthly in advance. They renew automatically each month and you can cancel any time - see "You own your site," below.
- Payments are processed securely by Stripe (card or ACH). Prices are in U.S. dollars. You're responsible for any third-party fees passed through (e.g. a premium domain or paid stock assets), which we'll name before incurring them.
Care-plan scope & turnaround
- Each care plan includes a defined number of minor content edits per month (the count is stated in your plan). Edits are handled on a batched, roughly two-business-day turnaround - not same-day or emergency service. We compete on quality and reliability, and we'd rather set an honest expectation than overpromise.
- Work beyond your monthly allowance, new pages, redesigns, or new features are quoted separately or billed at the hourly rate named in your proposal.
- Edits roll month to month only if your plan says so; unused edits otherwise don't carry over.
Refunds
- The setup deposit is non-refundable once work has begun.
- Build fees cover work performed; a delivered milestone is billable.
- Care plans: cancel any time and you won't be billed for the next month. We don't pro-rate a partial month, but your site keeps running through the period you've paid for.
- If we ever bill you in error or duplicate a charge, email hello@respecdigital.com within 30 days and we'll make it right.
You own your site (no lock-in)
This is a promise, not fine print. When your build is paid in full:
- Your website, content, and brand assets are yours. You own your domain and your data.
- You can cancel a care plan at any time and take your site with you - we'll hand off your files and help you move. No hostage hosting, no ransom to leave.
- If you cancel a care plan, our managed hosting, edits, and monitoring for that site end; keeping the site live afterward is your responsibility (we'll help you transition).
Your responsibilities
- Provide the content, images, logos, and information we need, and confirm you have the rights to use everything you give us. You're responsible for the accuracy of your business details (hours, prices, claims, licensing).
- Maintain your own domain registration and email accounts unless we've agreed otherwise in writing.
- Review what we deliver and let us know about issues promptly.
Third-party services & uptime
Your site relies on third parties - typically Netlify (hosting), Stripe (payments), your domain registrar, and any tools we integrate at your request. Those services are governed by their own terms, and we don't control their performance. We target high availability and monitor your site, but we can't guarantee uninterrupted, error-free service, and we're not liable for outages or data loss caused by a third-party provider.
Text messaging (SMS)
- If you give us your mobile number on one of our forms, you consent to receive service text messages from ReSpec Digital related to your request - for example, your checkout link, an order confirmation, a clarifying question, or a delivery update. These are conversational, one-to-one messages; we do not send marketing or promotional texts.
- Message frequency varies based on your conversation with us. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- Reply STOP to any message to opt out at any time, or HELP for help. You can also email hello@respecdigital.com.
- We never sell or share your mobile opt-in information with third parties for their marketing. See our Privacy Policy for the full detail.
Showcasing our work
We may display sites we've built in our portfolio and marketing, with a clear note of who they belong to. If you'd prefer we don't feature your project, just tell us and we'll keep it private.
No guarantee of results
We build modern, fast, professional websites and we stand behind our craft. But a website is one factor among many, and we do not guarantee any specific search ranking, amount of traffic, number of leads, sales, or revenue - those depend on things outside our control. Our services are provided on a professional-effort basis and, except as expressly stated in your proposal, "as is."
Limitation of liability
To the fullest extent permitted by law, Side Quest Adventure LLC (operating as ReSpec Digital) is not liable for any indirect, incidental, or consequential damages arising from your use of our services or your website. Our total liability for any claim will not exceed the amount you paid us for the service giving rise to the claim in the three months before it arose.
Ending an engagement
Either of us may end a project or care plan with written notice. You're responsible for fees for work performed up to that point; we'll deliver what you've paid for and help you transition your site. We may suspend or end service for non-payment or misuse.
Changes to these terms
We may update these terms as the service evolves; the effective date above reflects the latest version. For an active project or care plan, material changes won't apply retroactively to the scope and price in your signed proposal.
Governing law
These terms are governed by the laws of the Commonwealth of Kentucky. Any dispute will be handled in the state or federal courts located in Madison County, Kentucky.
